Compensation for Wrongful Death

In Connecticut a wrongful death lawsuit is brought by a personal representative or executor of the decedent’s estate. Any damages that are recovered by the estate in the lawsuit are distributed according to the terms of the decedent’s will. If the decedent did not have a will, the damages are distributed by the intestacy laws, i.e. laws that control how estates are distributed in the absence of a will.

Damages allowable for wrongful death in Connecticut include:

— value of decedent’s lost earning capacity less deductions for necessary living expenses

— compensation for destruction of capacity to carry on and enjoy life’s activities in a way she would have done had she lived, and

— compensation for conscious pain and suffering. C.G.S.A. § 52-555.

— funeral and medical expenses

Unlike other states damages are not awarded to family members for loss of guidance or sentimental loss.
